I accept for use as is the equipment listed on this form, and accept full financial responsibility for the care of the equipment while it is in my possession. I will be responsible for the replacement at full value of any equipment rented under this form, but not returned to the shop. I agree to return all rental equipment by the agreed date.
I understand that the binding system cannot guarantee the user’s safety. In downhill skiing, the binding system will not release at all times or under all circumstances where release may prevent injury or death, nor is it possible to predict every situation in which it will release. In snowboarding, cross-country skiing and snowblade use, the binding system will not ordinarily release during use: these bindings are not designed to release as a result of forces generated during ordinary operation.
I understand that the sports of skiing, snowboarding, snowblade and other recreational activities involve inherent and .other risks of INJURY and DEATH. I voluntarily agree to expressly assume all risks of injury or death that may result from skiing/snowboarding/snowblade use, or which relate in any way to the use of this equipment.
I AGREE TO RELEASE the ski/snowboard shop, its employees, owners, affiliates, agents, officers, directors, and the manufacturers and distributors of this equipment (collectively “PROVIDERS”), from all liability for injury~ death, property lose and damage which results from the equipment user’s participation in the sport of skiing/snowboarding/snowblade use, or Is in any way related to use of this equipment, Including all liability which results from the NEGLIGENCE of PROVIDERS, or any other person or cause.
I further agree to defend and identify PROVIDERS for any loss or damage. including any that results from claims or lawsuits for personal injury, death and property loss and damage related in any way to the use of this equipment.
This agreement is governed by the applicable law of this state or province. If any provision of this agreement is determined to be unenforceable, all other provisions shall be given full force and effect.
Financial Responsibility & Damage Policy
1. Equipment Care and Return The Renter accepts the equipment listed in this agreement in "as-is" condition and agrees to return it in clean, undamaged condition by the date and time specified. Failure to return equipment on time will result in late fees charged at the standard daily rental rate.
2. Assumption of Financial Liability The Renter assumes full financial responsibility for the care of the equipment during the rental period. In the event of theft, loss, or damage to the equipment beyond normal wear and tear, the Renter agrees to pay the shop the full retail value of the equipment (in the case of loss/theft) or the full cost of replacement parts and professional repair labor (in the case of damage).
3. Normal Wear vs. Equipment Damage To clarify expectations, the shop distinguishes between standard operational wear and neglect or misuse:

Normal Wear and Tear (Covered): Minor superficial scratches on ski topsheets or bike frames, standard edge dulling, or light cosmetic scuffs from normal use on designated trails/slopes.

Equipment Damage (Renter Liable): Core shots or deep gouges to ski bases, cracked or broken edges, bent or broken bike rims, damaged derailleurs, torn seats, frame cracks, structural impacts, or damage resulting from riding on asphalt, rocks, or non-designated terrain.

If the equipment is lost, stolen, or damaged beyond repair, I agree to pay the full retail replacement price. If the equipment is damaged but repairable, I agree to pay the reasonable cost of repair. Standard repair fees include, but are not limited to:
3. Seasonal Lease Return Deadline and Late Penalties
I agree to return all property to the specific Colden Ski & Board Shop location from which it was rented no later than April 1, 2027.
If any item is not returned in undamaged condition within five (5) days of this due date, I authorize Colden Ski & Board Shop to charge my credit card on file for the full retail value of the unreturned equipment at the following rates:
4. Credit Card Authorization The Renter authorizes the shop to keep a valid credit card on file for the duration of the rental period. The shop reserves the right to charge this card for any late fees, unreturned items, or repair and replacement costs assessed upon the return and inspection of the equipment.
